Insolvency Resolution Process
M/s Creative Capital Services Ltd filed a petition under Section 95 of the Insolvency and Bankruptcy Code, 2016 before the Hon’ble National Company Law Tribunal, New Delhi Bench, Court II, bearing C.P. (IB) No. 690/ND/2025.
The petition was filed on 11 December 2025 for initiation of the insolvency resolution process of Mr. Suhail Goyal. The Hon’ble Bench admitted the matter through order dated 05 January 2026 and appointed Ms. Taruna Goel as the Resolution Professional.
Admission under Section 100
In furtherance of the proceedings, the Resolution Professional filed her report under Section 99 of the Code on 06 February 2026 after examining the petition and related documents.
On the recommendation of Ms. Taruna Goel, Resolution Professional, the Hon’ble NCLT, New Delhi Bench, Court II admitted the petition and passed an order dated 29 July 2026 under Section 100 of the Code for commencement of the insolvency resolution process of Mr. Suhail Goyal. The order was served to the Resolution Professional on 08 August 2026.
Moratorium under Section 101
With admission of the application under Section 100, moratorium has commenced in relation to all debts of Mr. Suhail Goyal. Pursuant to Section 101 of the Code:
No legal proceedings can continue or be initiated against the personal guarantor in respect of any debt.
The personal guarantor is barred from transferring, alienating, encumbering or disposing of any assets.
The restriction also applies to legal rights and beneficial interest in assets.
Public announcement has been issued inviting claims from creditors of the personal guarantor.
Invitation of claims
In pursuance of the order dated 29 July 2026 passed by the Hon’ble NCLT, New Delhi Bench, Court II, the Resolution Professional caused a public announcement inviting claims from all creditors of the personal guarantor.
The announcement was published in two newspapers, namely Amar Ujala and Financial Express, and the merged publication is available in the Documents section as Form A / Public Announcement.
